Obama Defers To Due Process Violations

This article from Reason magazine’s current issue is very revealing.  Instead of fulfilling campaign promises to rein in Bush-era abuses of civil liberties, the Obama administration has advocated through the Solicitor General that:

1.  The government has the power to arrest and detain US citizens without pressing charges.

2.  Defendants do not have a right to post-conviction DNA testing despite growing evidence that innocent people are routinely convicted for the crimes of others.  (You can read about those cases here.)

3.  Prosecutors should be protected from lawsuits even in cases where they manufactured evidence.

4.  Police have the right to enter homes without a warrant under “exigent circumstances.”  (The Court upheld this police action.)
